LASTING POWER OF ATTORNEY – YOU CAN NOW APPLY FOR THIS WITHOUT THE AID OF A SOLICITOR
Did you know you can now apply for/register a Lasting Power of Attorney without a solicitor? You can now compete application forms by either:
1. Visiting the website https://www.gov.uk/power-of-attorney and completing the application on-line
2. Alternatively, you can download the forms, print them off and fill out by hand and return.
3. Forms can also be posted to you. Contact the Office of the Public Guardian on 0300 456 0300.
Also attached to this email is the ‘Lasting Power of Attorney’ leaflet produced by the Office of the Public Guardian or you can follow this link – https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/778380/lasting-power-of-attorney-leaflet-a5.pdf
You will be interested in the costs. Usually it now costs £82 to register (far cheaper than going through a solicitor) but you may be able to get a reduction of 50% or get it free in certain circumstances. See the attached leaflet for more details.
If you want to know more or have questions you can visit the https://www.gov.uk/power-of-attorney website or call 0300 456 0300.
If you do not have a Lasting power of attorney in place and the patient is deemed to have lost mental capacity, You WILL need to to apply to the Court of Protection for a property and affairs deputyship. This is an expensive and difficult solution.
